Field of activity

Maja Šipek is an associate in the Banking & Finance team. She is advising global clients regarding tax law issues, acquisition and sale of performing and non-performing financial assets, regulatory banking matters, financing and refinancing projects  and capital markets. Additionally, Maja represents clients in Banking & Finance litigations and performs forensic legal reviews.

Amongst other matters, she was recently involved in i) forensic legal reviews in financial institutions and subsequent civil and criminal procedures; ii) advising various buyers and sellers regarding disposal of corporate and retail NPL portfolios or single tickets (total exposures up to EUR 800M); iii) financial restructuring of a group of companies; and iv) various financing and refinancing projects (face value up to EUR 500M).

Previous work experience / training 

Maja Šipek has been an associate with CMS since March 2017. Before joining CMS, she gained experience in a top-tier Slovene law firm (2015), in a ˝big four˝ firm (2015-2016) and a top-tier international law firm (2016-2017).

Relevant experience

•    forensic legal reviews of financial institutions and representation in subsequent civil and criminal procedures;
•    advising various buyers and sellers regarding disposal of corporate and retail NPL portfolios or single tickets (total exposures up to EUR 800M);
•    financial restructuring of a group of companies; 
•    various financing and refinancing projects (face value up to EUR 500 M);
•    representing a global reinsurance company in a multi-layer settlement regarding insured claims against management board members (EUR 55.5M); 
•    representing a large bank in a court procedure regarding damage liability of management (EUR 8M);
•    representing a large company in a corporate-specific litigation regarding alleged concealing of information to shareholders (EUR 28M), 
•    representing an international holding against market manipulation charges 
•    representing a multinational company before an international arbitration regarding breach of contract; 
•    representing a large Slovenian bank in a criminal procedure against its former management for abuse of position or trust in business activity.

Dispute Resolution

Field of activity

Maja Šipek is an associate in the Dispute Resolution team. She performs forensic legal reviews and advises international clients in civil and corporate pre-litigation and litigation proceedings. She also represents clients in negotiations and in front of arbitration courts. She particularly focuses on damage liability of management and supervisory board members and offers support to insurance companies in such disputes. 

Recently, she was involved in representation of i) a global reinsurance company in a multi-layer settlement regarding insured claims against management board members (EUR 55.5M), ii) a large bank in a court procedure regarding damage liability of management (EUR 8M), iii) a large company in a corporate-specific litigation regarding alleged concealing of information to shareholders (EUR 28M), iv) an international holding against market manipulation charges and v) a multinational company in front of an international arbitration regarding breach of contract (EUR 850.000).
