Maksym is a lawyer in the Energy & Climate Change practice at CMS Ukraine. He advises domestic and international clients on a wide range of legal and regulatory matters in the Energy, Renewables, Environmental and Oil & Gas sectors.

 In the Energy sector, Maksym advises electricity traders on their day-to-day operations and contractual relationships with Ukrainian counterparties.

 In the Renewable Energy sector, Maksym has significant experience providing legal support to foreign investors and developers on a variety of legal issues throughout all stages of renewable energy project implementation. He regularly advises clients on licensing and permitting procedures, grid connection and participation in the electricity market. 

 In the Oil & Gas sector, Maksym advises clients on matters involving production sharing agreements, licensing and permitting, natural resources legislation, and local content requirements. He has experience advising on the legal framework governing exploration and production, as well as the regulatory aspects of gas transportation, trading and storage in Ukraine. His recent work includes advising on legal due diligence, transaction structuring, and regulatory compliance in oil & gas infrastructure projects.

Relevant experience

  • Horizon Capital on acquisition of up to 45% equity stake in Notus Energy Libental GMBH (Germany), which owns 100% in Ovidiopol Energies LLC (Ukraine), which holds the rights to a 123.9 MW wind project in Ukraine
  • Horyzonty LLC, a member of the MND Group, in relation to the acquisition of Ukrainian Independent Geological Company LLC, a company operating in the upstream oil and gas sector based in western Ukraine
  • A syndicate of International Finance Institutions including European Bank for Reconstruction and Development, International Finance Corporation and Black Sea Trade and Development Bank, on EUR 157m financing provided to OKKO Group for the construction and operation of a private wind power project that aims to boost Ukraine’s energy security
  •  Green for Growth Fund on equity (minority stake acquisition) and debt investment in a Ukrainian company holding the project rights essential for the development, construction, and operation of a solar power plant
  • Arise AB on its acquisition of a 70% stake in Norway and Ukraine-focused renewables developer Fenix Repower AS in a bid to diversify its business technologically and gain a foothold in the Ukrainian market
  • Goldbeck Solar Investment on the contemplated acquisition of a portfolio of RES projects in Ukraine (due diligence and transactional parts)
  • Tetra Tech ES, Inc on various issues of the biomethane market’s implementation in Ukraine
  • MND a.s. on its acquisition of a 50% share in the 54.6 MWh Oriv wind power plant in Ukraine
