All new trusts applications and related transactions shall be carried out by the Business Registration Service (BRS) beginning Monday, 3 June 2024, at their offices in Nairobi, Kenya.
This follows the recent amendment to the Trustees (Perpetual Succession Act) Cap. 164, by the Statute Laws (Miscellaneous Amendment) Act, which transferred the responsibility of registering, incorporating and keeping records of Trusts to the Business Registration Service (BRS).
With effect from 22 May 2024, the State Department for Lands and Physical Planning effectively stopped receiving applications for registering and incorporating trusts and all pending applications shall be completed by the BRS.
