Law No. 1577 on the promotion and regulation of shared residency for children of separated parents of 1 July 2025 was published on 11 July 2025 in the Journal de Monaco.
The new provisions of Law No. 1577 have therefore been in force since 12 July 2025.
These new provisions allow guardianship and divorce judges, where the best interests of the child so require, to determine, even on a temporary basis, the habitual residence of the child, alternating between the homes of each parent, even if one of the parents disagrees.
The law is applicable immediately.
