The EU intends to extend state aid control to business support provided by non-EU governments. This new area of law is expected to enter into force soon. We help companies prepare for the upcoming new regulations and assess the associated business risks. The new legislation will essentially introduce three new instruments, one that will qualify as a second merger control by the EU, a second that will introduce new requirements for tenders and a third that will allow the European Commission to launch ex officio investigations on a case-by-case basis against subsidies from third countries. 

The new law will give EU companies more opportunities to complain about subsidies from third countries (and their recipients) that affect the EU market, but it will also create new barriers for many non-EU companies and lead to additional regulatory requirements for companies, including those based in the EU.
