Workplace Safety and 231

Decree-Law No. 159 of October 31, 2025 (known as the Security-Work Decree), published in the Gazzetta Ufficiale della Repubblica Italiana, introduces “Urgent measures for the protection of health and safety in the workplace and in the field of civil protection.”
Its aim is to strengthen the culture of safety, reduce accidents, and promote prevention across all production sectors. The Security-Work Decree significantly reinforces the connection between 231 compliance and workplace safety, marking a crucial step toward an integrated system of safety, transparency, and corporate responsibility.

Companies will be required to:

 ➤ Integrate controls and procedures:

  • Digital badges: in the event of accidents or irregularities, failure to adopt or properly manage digital badges may give rise to liability under Legislative Decree 231.
  • PPE: companies must update their Risk Assessment Document (DVR) and periodic inspection procedures, integrating these aspects into the 231 Model to ensure traceability of checks and adequacy of devices. This also contributes to excluding the company’s liability in cases where accidents are caused by improper use or failure to use PPE.
  • Training processes: periodic training assumes strategic relevance under 231 as a preventive measure and a tool for risk mitigation.

➤ Strengthen the traceability of inspections and near-miss reports, which become key defensive and evidentiary tools. In this context, aggregated data and corrective actions communicated to the Ministry will function as reward elements and, in 231 terms, as evidence of organizational diligence in the event of legal proceedings.

➤ Involve the Supervisory Body (SB) in overseeing new prevention measures and in monitoring contracts and subcontracts.

➤ Update Model 231 in light of regulatory changes and new operational practices in the field of occupational health and safety. Organizational models compliant with UNI-INAIL guidelines or with UNI EN ISO 45001:2023+A1:2024 are presumed to meet legal requirements concerning occupational health and safety.

➤ Update the company’s Code of Ethics, introducing principles of shared responsibility for safety and personal protection.


A systematic review of 231 Organization and Management Models and internal controls becomes a lever for competitive value and a source of legal protection for the company and its management.
For companies, compliance is not only an obligation but also a strategic investment in reputation, sustainability, and business continuity.
