CMS DSB represents New Horizons

CMS Derks Star Busmann has successfully represented New Horizons, an international IT training centre, in a case against IT business owner Camiel de Clercq. With 300 training centres in 70 countries, New Horizons is one of the largest IT training centres in the world.

In April 2010 New Horizons terminated the franchise contract with De Clercq’s company NH Corporate Training. Even though De Clercq was therefore no longer entitled to use the brand name, teaching methods and teaching materials of the US company, it continued doing so.

In the interlocutory proceedings on 4 June 2010 the court decided that De Clercq and his staff were no longer entitled to present themselves as New Horizons representatives. For each violation of the court’s decision they will incur a penalty of EUR 10,000.

Bart Bendel and Anita Canta acted as advisors for New Horizons in this case, which attracted attention in the Dutch IT media.
