Ukraine amends rules for commissioning construction projects and using the sector’s state electronic system

On 21 January 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 50, introducing amendments to:
- the Procedure for Commissioning of Completed Construction Projects, approved by Resolution of the Cabinet of Ministers of Ukraine dated 13 April 2011 No. 461; and
- the Procedure for Maintaining the Unified State Electronic System in the Construction Sector (USESC), approved by Resolution of the Cabinet of Ministers of Ukraine dated 23 June 2021 No. 681.
The key element of the introduced amendments is the formalisation of the use of the “Transparent Construction” mobile application as a component of the USESC for conducting and recording the results of on-site inspections of construction projects. These changes form part of the state policy governing the digitalisation of construction-related procedures, which are intended to increase transparency, traceability and uniformity of the commissioning process for completed construction projects.
Commissioning procedure overview
Under a general rule, completed construction projects are commissioned under either a declarative or a certification-based procedure, depending on the project’s consequence class (СС).
Projects with a minor consequence class (СС1) are commissioned under a declarative procedure by submitting a declaration of readiness for operation together with a technical passport and do not require an on-site inspection. Projects with medium and significant consequence classes (СС2 and СС3) are commissioned under a certification-based procedure. This procedure includes a mandatory on-site inspection, after which the competent authority will decide on the issuance of a commissioning certificate.
Amendments introduced by Resolution No. 50
The Resolution does not change the general approach to commissioning procedures. At the same time, it significantly transforms the procedure for conducting on-site inspections within the certification-based commissioning process for projects with a medium class (CC2) and significant consequence class (CC3).
Digitalisation of on-site inspections and the “Transparent Construction” application
The new addition in Resolution No. 50 is the regulatory formalisation of the mandatory use of the Unified State Electronic System in the Construction Sector, in particular the “Transparent Construction” mobile application, in the generation of checklists and the creation of photo and video recording during on-site inspections of construction projects.
According to the Resolution, the checklist is generated by an official of the state architectural and construction control authority directly at the inspection site, signed with a qualified electronic signature, and automatically transferred together with the recording materials to the Construction Activity Register of the Unified State Electronic System in the Construction Sector. Based on this digital document, a statement required for the issuance of the commissioning certificate is prepared. Such an approach eliminates the possibility of correcting or substituting inspection results after the inspection has been completed.
Update of the on-site inspection checklist
Resolution No. 50 changes Annex 8 to Procedure No. 461, which significantly revises the content of the on-site inspection checklist. The checklist has become more structured and detailed, with a clear division into functional blocks.
The updated checklist primarily covers verification of the availability of documentation, accessibility of the project for persons with reduced mobility, fire safety compliance, engineering systems, site improvement, interior finishing, and the availability of civil protection shelters.
Changes in the functioning of the Unified State Electronic System in the Construction Sector
Amendments to Procedure No. 681 officially include the “Transparent Construction” mobile application as a functional component of the Unified State Electronic System in the Construction Sector. The system’s functionalities have been expanded to ensure the creation and transmission of electronic documents, photo and video recording during the provision of administrative and other services in the construction sector, as well as user access to the Construction Activity Register via the “Transparent Construction” mobile application.
As a result, information on the performance and results of on-site inspections is recorded in the Unified State Electronic System in the Construction Sector and becomes available through the Construction Activity Register. Mandatory photo recordings strengthen the evidentiary value of inspection results.
The introduction of digital recordings of inspection results, including using the mobile application directly during site visits, will minimise the risks associated with the use of third-party, outdated or unreliable materials.
Practical implications
The amendments introduced by Resolution No. 50 were created to standardise, digitalise and increase the transparency of commissioning procedures for construction projects by electronic control tools. The updated framework reduces the scope for discretion during inspections and reinforces the importance of the actual condition of a project at the time of commissioning.
