Key employment issues across Europe and beyond

Our latest edition of On Your Radar contains a number of interesting themes, including the interaction between app based technology and employment law. While the issues raised in the Spanish gig economy case involving delivery riders are not new, the finding of self-employment goes against the general trend for platform based working.

Moving away from the gig economy but remaining with app based technology, is the development reported by the Netherlands of the growth in digital tools for monitoring performance. Companies are asking their employees to use designated apps to give feedback on their colleague’s performance, with the resulting demise in annual performance reviews. Online workplace reporting tools are not limited to monitoring employee performance. In the US there has been a growth in this type of technology to encourage employees, and in some case students, to report harassment. The benefits of online reporting tools for harassment has also found favour with the UK national equality body, which recently issued a report on harassment  recommending employers should implement these systems. The pace of change in the digitalisation of HR continues!

If you want to get in touch to find out more about a development in a particular country covered, or any other CMS jurisdiction, please speak to your usual CMS contact or e-mail employment@cmslegal.com.
