With Order No. 163 of 25.11.2025 (the “Order”), the Italian Insurance Supervisory Authority (“IVASS”) introduced amendments to IVASS Regulations 40 and 41 of 2018, and to the related annexes, in view of the start of operations of the Insurance Arbitrator (“AAS”), scheduled for 15.01.2026.
In particular, the Order affects the following aspects:
- insurance intermediaries’ and insurers’ websites and/or social media channels, which must display on the home page (or on a dedicated page accessible from the home page) the option to apply the AAS – or an alternative dispute resolution (ADR) system from the FIN.NET network – through a hyperlink redirecting users to the dedicated website;
- MUP (single pre-contractual model) for insurance and insurance-based investment products (IBIPs), which must indicate the option to apply the AAS (or another ADR from the FIN.NET network), also through a link to the dedicated website;
- Additional IPID (additional pre-contractual information document) for life, IBIPs, multi-risk, non-life and motor liability products, which, similarly to the website and the MUP, must indicate the possibility of applying the AAS (or another FIN.NET ADR) and include the relevant website; furthermore, the Order specifies that the Additional IPIDs may occupy one additional page to allow for the inclusion of the information relating to the AAS or the alternative ADR.
The Order further establishes that the adjustment of (i) the website, (ii) the MUPs, and (iii) the Additional IPIDs must be carried out by insurance intermediaries and insurers by 14.01.2026, that is, the day before the start of AAS operations.

The obligation set out in Article 12(2) of Decree No. 215/2024 of the Italian Ministry of Enterprise (MIMIT) remains unchanged. This requires intermediaries and insurers to publish the AAS decisions issued against them that they did not comply with on a dedicated section of the home page of their website for a period of six months.
Finally, please note that the AAS has jurisdiction over disputes whose value does not exceed the following amounts:
- 🛡️ for disputes relating to life insurance contracts
- € 300,000 for disputes concerning human life insurance contracts (Class I) and benefits payable in the event of death
- € 150,000 in all other cases
- ☂️ for disputes relating to non-life insurance contracts
- € 2,500 if the dispute concerns a civil liability claim brought by an injured party directly against the insurer of the liable party, i.e. mainly medical liability, motor liability and hunting liability
- € 25,000 in all other cases
