Intervention of foreign companies

The Principality of Monaco, as a dynamic and attractive economic hub, hosts numerous construction projects, both public and private. However, the exercise of activities on its territory is strictly regulated, particularly for foreign companies wishing to operate on a construction site, both in terms of labor law and construction law, to ensure compliance with all interventions.

Mandatory Prior Authorizations

Foreign companies wishing to operate on a construction site in Monaco must imperatively obtain authorization to operate, even for occasional interventions (beyond 48 hours) or those limited in time.

This requirement applies to both companies from the European Union and those from outside the EU.

The procedures to be completed with the Direction of Economic Development and the Employment Service are as follows:

  • A site authorization allowing the company to operate in the Principality.
  • Authorization for the secondment of its employees to Monegasque territory.

These authorizations must then be submitted to the Caisse des Congés Payés du Bâtiment (CCPB), along with the required documents.

Professional Construction Card

At the end of the process, a professional construction card is issued by the CCPB for each concerned employee. This card is mandatory for anyone carrying out an activity in the construction sector in Monaco (list of activities set by ministerial decree).

Compliance with Monegasque Legislation

Furthermore, foreign companies must comply with Monegasque labour legislation, particularly regarding prior declaration of employment, minimum remuneration, working hours, site safety, and social protection of employees.

Failure to comply with these obligations exposes the company to administrative and criminal sanctions, or even a ban on operating in Monaco, especially in the context of combating money laundering, the financing of terrorism and the proliferation of weapons of mass destruction, and corruption.
