Enrique has over 25 years' experience advising clients through all stages of infrastructure projects, including conceptualization and structuring, engagement through public bidding procedures or private contracting, development and construction, as well as financing and daily operation of the projects once they have been completed.

He has advised construction companies on their participation in public biddings and private contracting for the construction of infrastructure in Mexico, various other Latin American countries and Spain. Enrique has also advised the federal government and state governments on the public bidding and awarding of concessions and long term services agreements for the development of infrastructure.

He has significant experience in the preparation of PPP contracts, procurement and construction contracts, as well as in the financing of infrastructure projects. He has participated in various projects that have received national and international recognition for their complexity and innovation, including hospitals, prisons and the closure of the world’s second largest landfill and utilisation of the biofuel to generate electricity.

Relevant experience

  • Mexico City Government on the definitive closing of the Bordo Poniente Stage IV Landfill (the largest landfill in Latin America), as well as the construction and launch of the electric plant that will use the methane gas from the landfill to generate electricity for self-supply purposes of the Mexico City Government.
  • Construcciones y Desarrollos Inmobiliarios Santa Fe (CODESA) on the negotiation and implementation of a Public Works Contract with the Ministry of Infrastructure of the State of Puebla, as well as on obtaining the necessary financing for the project.
  • CODESA on negotiating the expansion of the public works contract for the construction of the platform for the Audi automotive plant, under the modality of “investment project”, with the Government of the State of Puebla.
  • Grupo INDI, Grupo Hermes and IDINSA on the public bidding procedure and granting of the long term services agreement for the optimisation and maintenance of the Mexico City Circuito Interior freeway.
  • Grupo INDI on the granting of a concession of public properties for the design, construction, operation and maintenance of an underground parking lot and additional commercial services.
  • Alstom, Grupo Indi, ADO, RATP and other companies on their participation in the public bidding of a long term services agreement for the design, financing, construction, fabrication and operation of the Mexico City tramway under the PPS programme.
  • IDINSA and Grupo INDI, the winning bidder of the Nuevo Italia-Apatzingan PPS Federal Shadow Toll Road on the financing and implementation of the project.

  • CODESA on the structuring, negotiation and signing of a loan increase with Banco Interacciones and Banco Monex, for financing the construction of the platform for the Audi automotive plant.
  • Banco Multiva on various amendments to the loan documents and guaranties, in connection with a loan granted to the constructor of the Bus Rapid Transit system in the State of Mexico called “Mexibus 2”.
  • Grupo INDI and Idinsa on the structuring, negotiation and signing of a mezzanine loan, with respect to their participation in the CEVASEP I & II projects.
  • Dexia Crédito Local Mexico on the modification of the loan documents granted by a national and international bank union, derived from the financial equilibrium of the Nuevo Necaxa – Tihuatlán highway concession.
  • Mexico Power Group on financing various wind farms in Mexico, including structuring of payment guarantees granted by state and municipal governments under PPP contracts for the supply of electricity derived from wind energy.

Enrique specialises in Real Estate and Infrastructure. In over 20 years of professional practice, he has advised on some of Mexico’s most significant real estate developments and continues to represent clients as a trusted adviser on important developments and investments for domestic and international organisations.

He has represented landowners, developers and investment funds on complex lease arrangements, as well as on the sale and purchase of commercial, industrial, residential and corporate properties.

He has significant experience advising on the legal aspects of property development in Mexico, as well as the structuring of associations, trusts and companies between developers, landowners and institutional investors.

Relevant experience

  • A joint venture between Grupo O’Donnell and AIG Global Real Estate on built-to-suit lease agreements for the construction and lease of Audi's automobile manufacturing plant and several just in time facilities for Audi's suppliers in Mexico.
  • Cinépolis on the establishment of a SIBRA (real estate investment company) and the drafting and implementation of legal acts and documents for the contribution as company stock and payment in kind of approximately 21 commercial buildings and shopping centres located in various Mexican states, in a period of 3 months, with an approximate value of US$160million.
  • Deka Immobilien GMBH on the acquisition, through a forward purchase of an underdevelopment, of two Class A+ office buildings with approximately 65,000 m² of income-producing leasable area, located in Polanco, Mexico City, for US$360million.
  • A joint venture between Grupo O´Donnell and Prudential Real Estate Investors on the drafting and negotiation of lease and purchase agreements over industrial premises, and the lease of warehouses in various states of Mexico.
  • Cinépolis on the development of the Churubusco shopping centre, including carrying out buyer due diligence and post-completion negotiation and drafting of tenant lease agreements.
  • Walmart Mexico on the negotiation, due diligence and drafting of lease and purchase agreements for the establishment of several Walmart retail stores, restaurants and supermarkets throughout Mexico.
  • Invertierra on a tailor-made lease agreement for a AAA corporate and commercial building in Santa Fe, to be used by Coca-Cola and FEMSA as their corporate headquarters in Mexico City.
