Gabriel is a former deputy General Director of Investigations at the Mexican Federal Economic Competition Commission.

Gabriel specializes in Competition Law and has extensive experience advising a wide range of companies on this matters. In his career he has advised multiple clients involved in merger notification procedures, cartel behaviour and abuse of dominance investigations, barriers to competition, leniency applications, calls for opinion for cross ownership and public bids, as well as trial-like procedures and amparo indirecto actions (constitutional injunctions). He has also developed competition compliance and risk prevention programs for several companies.

 

Relevant experience

The matters in which Gabriel has recently participated include the following:

 ·         Represented one of the largest players on the real estate developers market (malls), on the investigation and trial-like procedures due to cartel behaviour conducted by the Federal Economic Competition Commission.

·         Represented one of the global largest players on the diapers and other cellulose products market, on the leniency application, investigation, trial-like procedures due to cartel behaviour conducted by the Federal Economic Competition Commission, as well as on the following amparo action, and in the implementation of its compliance program focused on competition.

·         Represented the largest player on the lab tests and blood bank services in Mexico, on the leniency application, investigation, trial-like procedures due to cartel behaviour conducted by the Federal Competition Commission, as well as on the following amparo action.

 ·         Represented one of the most popular professional soccer clubs in Mexico, on the leniency application and investigation due to cartel behaviour conducted by the Federal Economic Competition Commission.

 ·         Represented a Spanish energy company on the sale of a natural gas pipeline located in Mexico, to an Australian fund, obtaining clearance from the Federal Economic Competition Commission.

 ·         Represented one of the most successful tech startups in Mexico on the sale of its mobility as a service business, to a Dubai based company, obtaining clearance from the Federal Economic Competition Commission.

 ·         Represented one of the most successful food and services delivery startups in the world in their joint venture with a large Mexican bank, obtaining clearance from the Federal Economic Competition Commission.

 ·         Advised the largest Internet powered search engine in the world in multiple competition matters.

 ·         Represented a Swiss company on the sale of its science and tech agricultural business, to the Chinese government, obtaining clearance from the Federal Economic Competition Commission.

Publications

Gabriel authored the only book about merger control in Latin America (Porrúa) and published several papers with the American Bar Association (US), the International Bar Association (US), the International Chamber of Commerce (México and France) and Instituto de Investigaciones Jurídicas  - UNAM (México). 

Memberships & Roles

Gabriel is an active member of the International Chamber of Commercee and Secretary of the “Cartels Working Group” of the Competition Section of the International Bar Association. He has also been invited as a speaker at national and international fórums, ie. the International Chamber of Commerce (México), the National Corporate Lawyers Association (ANADE - México), the World Bank (Zambia), the Asia Pacific Economic Cooperation (APEC - Perú), the Competition Private Miniclub (Brasil) and the Externado University (Colombia), among others.

He has been recognized as a “rising star” and a “recommended lawyer” by the Legal 500 and Best Lawyers rankings.

Lectures list

He currently lectures Competition Law at Universidad Iberoamericana.

 

Education

Gabriel obtained his law degree from Universidad Iberoamericana, his LLM in Business Law from Universidad Autónoma de Madrid (Spain). He also obtained a LLM in European Competition Law from Kings College London.
