Cecilia Vargas is a partner in the Labour practice at CMS Grau. She is an expert in labour law, social security, prevention of workplace sexual harassment, and immigration procedures. She advises a wide range of domestic and international companies on matters within her area of expertise, as well as on the defence of disputes in administrative, judicial, and arbitral proceedings.

She has extensive experience in the hiring of local and foreign employees, including the obtainment of the corresponding work authorisations and immigration statuses. She also advises on labour audits and labour inspections. In addition, Cecilia provides comprehensive advisory services ranging from workforce planning and labour policy design to complex matters involving collective bargaining, terminations, union relations, and labour restructurings.

Cecilia holds a law degree from the Universidad de Lima and has completed postgraduate studies in Labour Law. She has been recognised as a leading labour lawyer by Chambers and Partners and The Legal 500. She is also the author of several articles on trending labour law topics and regularly participates as a speaker at conferences and events.

Relevant experience

  • Petrex (SAIPEM) | Advised on more than 20 judicial proceedings, most of them related to reinstatement claims and social benefits payments. The complexity of the engagement stemmed from provisional reinstatement orders issued in a significant number of cases, despite the company’s inability to comply due to the absence of available positions at its facilities.
  • Schlumberger | Advised on the implementation of sexual harassment prevention policies, as well as on contingency management relating to the outsourcing of services.
  • Solgas | Advised on more than 180 judicial proceedings and administrative procedures involving a variety of matters, including occupational diseases.
  • Sodimac Perú | Advised on the implementation of all measures adopted under the new organisational structure following the acquisition of Maestro Perú S.A., including workforce terminations, and assumed the defence of Maestro Perú S.A. in all judicial proceedings nationwide, as well as administrative proceedings before the Labour Authority and EsSalud, among other matters.
  • Saga Falabella | Advised on collective bargaining negotiations with the workers’ union, acting as company negotiator in the process. The union’s list of demands represented an approximate economic value of USD 3.5 million.
