Jamileth Valera is an Associate in the Infrastructure and Projects practice at CMS Grau. Her work focuses on the management and development of public and private infrastructure projects, with an emphasis on contract management and the resolution of disputes arising during project execution.

Her experience includes advising construction companies and concessionaires on public works, Government-to-Government schemes and concession projects across the transport, water, energy, health, education and urban infrastructure sectors. She has experience in administering and analysing engineering, construction and EPC contracts, as well as standardised FIDIC and NEC contract models.

She has been part of teams responsible for handling arbitration proceedings related to extensions of time, variations, land availability, penalties, loss of productivity and latent defects, as well as submissions before Dispute Adjudication Boards and Dispute Resolution Boards.

Jamileth holds a Law degree from the Pontificia Universidad Católica del Perú, where she graduated Suma Cum Laude. She has completed specialised studies in administrative law and in NEC and FIDIC contracts, strengthening her practice focused on contract management for infrastructure projects. 

Relevant experience

  • Advised on the management of the NEC3 Option F Contract for the execution of “Package 1 – Comprehensive Solutions for the San Idelfonso and San Carlos Ravines”, an infrastructure project with an estimated investment of over PEN 1.4 billion, aimed at mitigating flood risks caused by El Niño-related disasters and protecting more than 300,000 inhabitants of the province of Trujillo, in the department of La Libertad.
  • Advised on the execution of the EPC Contract for the New Passenger Terminal of the Jorge Chávez International Airport, an airport infrastructure project with an investment exceeding PEN 1 billion, supporting construction processes, management of contractual milestones, extensions and regulatory compliance.
  • Advised on the execution of the NEC4 ECC Contract for the design and construction of “Package 05: Escuelas Lima 5”, as part of the Bicentennial Schools programme, a national educational infrastructure initiative aimed at closing gaps, improving construction standards and fostering collaborative contract management.
  • Advised on the execution of the Concession Contract for the Longitudinal de la Sierra Highway – Section 2: Ciudad de Dios – Cajamarca – Chiple – Cajamarca – Trujillo – Dv. Chilete – Emp. PE-3N, participating primarily in the Rehabilitation and Improvement, Initial Periodic Maintenance and Operation stages.
  • Advised on contract management, risk and regulatory compliance for the EPC Contract of Line 2 of the Lima and Callao Metro, a major underground mass-transit project.
  • Advised Consorcio Nuevo Olmos on the execution of Works Contract No. 02-2016-VIVIENDA-PNC, for the installation of road networks, potable water and sewerage systems in the New City of Olmos, with a final project value of approximately PEN 450 MM, ensuring contractual, regulatory and technical compliance.
  • Advised Consorcio Nueva Gambetta on its successful representation in the arbitration concerning the final settlement of the “Improvement of Néstor Gambetta Avenue – Callao” project, valued at approximately PEN 500 MM, obtaining an award in favour of the contractor of nearly PEN 14 million and consolidating a favourable legal position.
