Agata Pawlak is an attorney-at-law and an Associate in the IP/TMC Team at CMS Warsaw office.

She serves key TMC clients, focusing on legal issues relating to intellectual property, media and telecommunications law. She also offers legal advice on IT, cyber security and personal data protection. Agata supports the team in drafting legal opinions, licence and IP rights transfer agreements and submissions, in addition to representing clients in patent, trademark and copyright infringement cases, as well as preparing IP, IT and data protection due diligence reports. She also deals with telecoms and media market regulation, as well as collective rights management organisations.

Additionally, Agata has unique experience in representing and supporting clients in the legislative process, specifically in conducting negotiations with stakeholders and proposing amendments to both Polish and EU legal acts, e.g. the draft Electronic Communications Law (implementing the European Electronic Communications Code), the Act on the Processing of Passenger Name Record Data, the Act on the National Cyber-Security System, the draft legislation on investment in the National Data Processing Centre or the draft law amending the Copyright and Related Rights Act (transposing the DSM and SatCab II Directives). 

Agata enhances her knowledge of law and new technologies by monitoring and commenting on European legislative initiatives aimed at raising the digital awareness of the society and strengthening the Member States’ regulatory policies to protect intellectual property and data through the use of innovative IT solutions (such as the cloud, cryptographic protocols, data encryption mechanisms, secure enclaves, etc.).

Agata won the award for the best MA thesis in the Kazimierz Kolańczyk Competition in 2019. Since 2022, she has been a member of the Warsaw Bar Association of Attorneys-at-Law.
