Aleksander Woźniak is an advocate and a Counsel in the Dispute Resolution Department at CMS. 

Aleksander has experience in advising clients primarily from the construction, finance, and telecommunications sectors, as well as public entities. His professional interests focus mainly on representing clients in disputes before state courts and in arbitration – both domestic and international – as well as in related business and settlement negotiations. 

Aleksander’s experience also includes a 9-month secondment with a leading global mobility service provider company, where he acted as a regional in-house counsel responsible for multiple jurisdictions in the CEE region.

Aleksander has provided advice to clients in international and domestic commercial arbitration disputes related to a number of construction and telecommunications projects, and to a state in an investment arbitration under a bilateral investment treaty. In addition, he has acted before state courts for Polish and foreign companies in construction disputes, and represented companies from the financial and insurance sectors in matters concerning protection of consumer rights, including a major class-action litigation proceeding, and several cases involving decisions issued by the President of the Office of Competition and Consumer Protection.

Aleksander was a member of the CMS team that took first place in the Lewiatan Arbitration Moot Competition in 2015 for young lawyers. The team also gained second place in the Best Statement of Defence category.

During his studies, Aleksander represented the University of Warsaw in the international arbitration competition VIS Arbitration Moot in Vienna, and subsequently coached the University of Warsaw team. 

Prior to joining CMS in February 2013, he completed internships in other international law firms in Warsaw. 

Relevant experience

  • An international market leader in the heavy lifting and transport sector in two parallel disputes concerning damages sought by the bankruptcy receiver of a bankrupt Polish construction company in relation to a bridge construction project in Poland, and in bankruptcy proceedings concerning the same Polish bankrupt construction company and the same project.
  • An international engineering design company in arbitration proceedings before the Court of Arbitration at the Polish Chamber of Commerce in Warsaw. 
  • A Hungarian company from the energy sector in a dispute under the ICC Rules of Arbitration rules concerning a claim resulting from a consortium agreement governed by Swiss law. 
  • A major Polish company from the construction sector in a court dispute concerning outstanding remuneration for the works completed until the termination of the FIDIC-based agreement.
  • A French company from the telecommunication sector in international arbitral proceedings before the Court of Arbitration at the Polish Chamber of Commerce in Warsaw.
  • An international life sciences company in relation to settlement negotiations concerning intellectual property. 
  • A bank in relation to a major class-action litigation concerning consumer rights.
  • An anonymous client in relation to an investment dispute based on an agreement on the mutual promotion and protection of investments with a mining company concerning a concession for the exploration and prospection of copper and silver deposits.
