Maksymilian Nasilowski is an associate in the Intellectual Property and Technology, Media & Telecommunications practice at CMS Poland.

He is a trusted advisor to clients across the TMC sector, specialising in intellectual property, data protection, media and telecommunications, new technologies, and cybersecurity. He has led complex, multi-jurisdictional projects involving data residency and cross-border transfers, providing advice on both EU and local regulations in almost 60 countries.

Maksymilian supports clients with IP matters ranging from trademark and patent licensing to opposition proceedings before the Polish Patent Office and litigation before common courts. In the area of data protection, Maksymilian advises clients on GDPR compliance, and drafts and reviews policies and contracts. He also represents clients before the Data Protection Authority and administrative courts.

Maksymilian’s specialisation also includes telecom and media law, including the legal requirements for telemarketing in Poland, as well as on cybersecurity and tech regulations.

An active contributor to industry discussions, he has co-authored articles for Forbes Poland and Parkiet, covering developments in 5G technology and regulatory trends led by the Office for Electronic Communications.

  • Iron Mountain, on its Global Data Residency project and development of Binding Corporate Rules, enabling compliant cross-border data transfers. We coordinated work across 25+ jurisdictions, advised on the implementation of new SCCs, and supported formal proceedings with the Lead Authority — crucial for Iron Mountain’s global data-driven operations across regulated sectors.
  • Smart, in a civil law action concerning infringement of intellectual property rights – the distribution and import of fake products.
  • Syngenta on IP-related advice - all anti-counterfeiting cases in Poland, including criminal actions against distributors and importers of fake products.
  • Ocado, on e-commerce, consumer law, IP issues, as well as various regulatory issues, including cybersecurity, telco, critical infrastructure, radio equipment, and electromagnetic compatibility-related requirements, affecting the client’s business in Poland.
  • Becton Dickinson, on data protection and privacy compliance in Poland, including clinical research agreements with hospitals and healthcare professionals, internal compliance processes, and adapting to new local regulations in the health sector.
