Mateusz Borucki is a senior associate and an advocate in the Dispute Resolution Department.

Mateusz’s areas of practice and interest include civil law, civil procedure, construction disputes and arbitration.

Mateusz has gained his professional experience to date in commercial disputes relating to the construction of technical infrastructure facilities, in particular with regard to claims for damages, claims for recovery of undue performance and valorisation claims. Mateusz’s professional experience includes construction arbitration proceedings before the Court of Arbitration of the International Chamber of Commerce in Paris (ICC) and the Arbitration Court at the Polish Chamber of Commerce in Warsaw. In his practice, Mateusz is also involved in proceedings involving claims for protection of personal rights (violation of air quality standards) and bankruptcy proceedings.

Mateusz is also a graduate of a two-year course in English and European Law run jointly by Warsaw University and Cambridge University.

Relevant experience

  • A construction company in two court disputes related to the construction of a waste incineration plant. The total amount of the claims is approx. PLN 350m. 
  • A general contractor in a dispute regarding a number of claims (including claims for payment under a bank guarantee) raised against the employer under a contract for the construction of a section of the A1 motorway and in particular related to defects and errors in the construction design of a motorway bridge.
  • A member of a general contractor consortium of a gas pipeline in a cross-border ICC arbitration governed by Swiss law concerning the construction of a gas pipeline in Poland. 
  • A designer as respondent in an arbitration dispute concerning a construction project before the Court of Arbitration at the Polish Chamber of Commerce in Warsaw. 
  • A construction company in a dispute concerning the construction of a prestigious residential building in the centre of Warsaw. The pending litigation concerns mutual claims, including regarding the relevant time extension, additional costs, price adjustments and contractual penalties.
  • A mother of a handicapped adult in a precedential pro bono case (conducted for the Helsinki Foundation for Human Rights), who is entitled to an earlier pension and therefore is formally barred from obtaining an attendance allowance that is significantly higher than her earlier pension.
