Paulina Karpińska-Huzior is a tax advisor and a counsel in the Tax Team in the Corporate/M&A Department.

Paulina is an advocate and a Polish-qualified tax advisor with over 10 years of experience specialising in tax litigation in all aspects: representing in tax proceedings, enforcement proceedings, criminal fiscal proceedings before tax authorities, administrative and common courts as well as law enforcement authorities, Constitutional Tribunal and Highest Court. She also advises in tax legal matters regarding Polish income taxes, value added tax, excise duty, tax on civil law transactions and real estate tax.

Paulina represents and advises banks, railway, energy, construction and pharmaceutical companies as well as individuals in different tax matters.

Before joining CMS Paulina worked for Chadbourne & Parke LLP and Radzikowski, Szubielska i Wspólnicy Sp.k.

  • Global bank: won a case regarding liabilities in income tax resulting from overestimation of tax deductible expenses.
  • Global producer of grout: won a case regarding liabilities in income tax resulting from overestimation of tax-deductible expenses.
  • Construction Company: won a case regarding VAT overpayment resulting from acquisition of real property for construction purposes (despite accusations of fraud by tax authorities).
  • Global producer of contact lenses: won a court case regarding excise duty liabilities.
  • Leading cars manufacturer: Preparing of a constitutional complaint regarding compliance with the Constitution of regulations regarding costs in enforcement proceedings - a positive judgment of the Constitutional Tribunal, no. SK 30/14.
  • Fuel surcharge importer: conducting tax and court proceedings regarding liabilities in excise duty and fuel surcharge, complex legal support.
  • Manufacturer of heavy industry equipment: won a court case regarding penal fiscal liability of the members of the management board and shareholders of the company for tax fraud. The court cleaned clients of all charges, despite negative tax decision.
  • Global pharmaceutical company: won a court case regarding companies' liabilities for employees' social contributions (the court admitted the company made a correct qualification of a lecture as a contract for work not subjected to health insurance.
