Piotr Szczepański is an associate in the Dispute Resolution team in Warsaw.

He specialises in litigation and arbitration related to a variety of commercial disputes. He has taken part in arbitration proceedings conducted on the basis of the rules of the main international arbitration institutions, as well as in ad hoc proceedings under UNCITRAL rules. 

Piotr is able to advise on issues relating to jurisdiction, choice of law and cross-border recognition and enforcement of arbitral awards and judgments. He has experience in obtaining a range of injunctions in relation to international court disputes.

Piotr also advises both investors and contractors at all stages of the investment process. He has extensive experience in the legal aspects of construction project management, in particular regarding FIDIC contract procedures and risk management and counterclaims, both from the perspective of the contractor and the investor. Piotr has experience in infrastructure projects in terms of contract indexation and the impact of external factors on the contract. 

Relevant experience

  • Providing the contracting party with comprehensive legal advice and coordination (including claims management) in connection with a construction project (with a value of over PLN 1.9bn, approx. EUR 428m) concerning the expansion of key critical infrastructure in Poland as part of construction contracts based on the FIDIC model. Representing the contracting party vis-à-vis the general contractor, subcontractors and third parties;
  • Preparing legal analyses and providing ongoing advice to the concessionaire in the concession project for the construction of public utility infrastructure, with particular reference to the impact of the pandemic and the effects of the outbreak of the war in Ukraine on the implementation of the contract (contract value of over PLN 166m, approximately EUR 38m);
  • Representing general contractors in construction disputes concerning the expansion of expressways in Poland (in particular, the value of one contract based on FIDIC general conditions of contract was over PLN 500m, approximately EUR 113m);
  • Representing a general contractor in a court dispute against a railway infrastructure manager concerning claims arising out of a contract based on FIDIC conditions for the construction of a key railway line in Poland.
  • Preparing and implementing a negotiation strategy for a foreign railway company in a dispute with a Polish railway company regarding the adjustment of a lump-sum contract price due to the effects of the COVID-19 pandemic and the war in Ukraine.
