Technology Transformation - Consumer & Retail sector

2 min read

On this page

Technological advancement and AI continue to transform the manufacturing and sale of consumer goods, from enhancing personalisation and streamlining operations to reshaping customer experiences.

This report is the second edition in our Technology Transformation series. In this publication, we analyse data from a survey of over 500 GCs, senior in-house counsel and risk managers across various sectors. We asked our respondents about their experiences and expectations relating to the use of new technologies, what risks they associate with them and how they intend to deal with these risks.

We extracted and analysed the responses and compared them with the data and observations produced in our first Consumer & Retail sector report. For consumer and retail companies, customer and supplier demands are the top drivers of adoption of new technology. As AI-driven e-commerce is becoming the norm, the use of AI across the sector continues to increase. Key concerns include liability for products using AI, violation of third-party IP rights by training/use of AI and data protection disputes – issues more pressing here than in other sectors.

“Given the importance of IP in appealing to the hearts, minds and eyes of consumers, most businesses recognise the need to prioritise IP assets and related risks, whether protecting own IP or being mindful of that of third parties. But there is no room for complacency, as technology such as agentic AI will fundamentally change many customer purchase journeys.”

Tom Scourfield, Partner, IP, CMS UK

“Consumer products manufacturers often operate internationally so an arbitration clause is standard practice in such cross-border supply relationships, as it guarantees confidentiality in the proceedings and enables effective enforcement abroad. Retailers, on the other hand, operate in a market, where fast and face-saving negotiation solutions between parties that will continue to be contractually bound to each other in the future are feasible.”
