COVID-19 : WHAT YOU NEED TO KNOW ABOUT DEFERRED TAX DEADLINES FOR BUSINESSES

MAY 2020 MAIN TAX DEADLINES FOR BUSINESSES ARE POSTPONED TO 30 JUNE 2020

On 17 April 2020, the French tax authorities issued a new schedule for businesses’ main tax deadlines. May deadline for payment of direct taxes is deferred for businesses in dire straits. Practically speaking, any business may be granted deferral but those able to file and pay as initially planned are highly recommended to do so in support of governmental action for the businesses which are deeply impacted by the Covid-19 pandemic.

For the record, under their corporate responsibility commitment, major corporations may be granted deferral of payment of taxes and welfare levies if, and only if, they commit not to pay any dividend or engage in a stock buyback in 2020.

Please find below the deferral measures that are applicable to businesses subject to corporate income tax, whatever the economic sector may be (apart from the deferral of the public broadcast tax which is specific to the accommodation and food service industry).

As soon as they approve deferral of payment of their taxes and regardless of their specific situation, businesses must download the dedicated claim form from the impots.gouv.fr website (« Je ne peux pas payer mes impôts : que dois-je faire ? » section – Editor’s note : “I cannot pay my taxes : what shall I do ? ”). This form must be emailed either to the appropriate corporate income tax services or to the Division of major companies (Direction des grandes entreprises – DGE), depending on which services the business reports to. In our opinion, this form must be sent before 15 May and the corporate income tax balance must be specified in it with as much accuracy as possible.

Corporate income tax

Deadlines postponed to 30 June 2020:

  • filing of corporate income tax package (especially form nb 2065 and form nb 2050 sqq., but in our opinion, any other relevant form) for tax periods which ended in December 2019, January or February 2020;
  • filing of the statement of corporate income tax balance (form nb 2572) and related payment

Cotisation sur la valeur ajoutée des entreprises (CVAE - Editor’s note :  businesses’ added value tax)

Deadlines postponed to 30 June 2020:

  • filing of CVAE’s settlement and regularization return (form nb 1329-DEF) and payment of debit balance (where the balance is in credit, the 5 May initial deadline remains applicable);
  • filing of return regarding added value and number of employees (form nb 1330).

Professional fees, brokerage fees and royalties

The deadline for filing the DAS2 form, initially set on 15 May, is postponed to 30 June. The declaration sociale nominative (DSN – Editor’s note : Employees information return, to be passed on to welfare institutions), which was to be filed in April, may now be filed up until next August.
