ESMA: Deprioritisation of supervisory actions on the obligation to publish RTS 28 reports in light of the agreement on the MiFID II/MiFIR review

ESMA’s statement is intended to provide market participants with clarity with regard to reporting requirements under RTS 28, pending full application of the new rules under MiFID II.  ESMA expects national competent authorities not to prioritise supervisory actions towards investment firms relating to the periodic RTS 28 reporting obligation, from 13 February 2024 until the transposition into national legislation in all Member States of the MiFID II review.
