ESMA: Supervisory measures and penalties under Articles 4, 9, 10 and 11 of EMIR

ESMA has published its second annual report concerning supervisory measures carried out and penalties imposed by national competent authorities under EMIR. It identifies areas which might benefit from coordinated approaches by authorities, such as the supervision of non-financial counterparties in relation to the clearing obligation and the supervision of counterparties below the clearing threshold and of third country entities trading in OTC derivatives with significant impact in the EU.
