By decision of the district court of first instance of Amsterdam, the Netherlands, of 24 June 2016, a suspension of payments was granted to CoFi Maastricht B.V., DENO B.V., EMERGO SPORTSWEAR B.V., Gaastra International Footwear B.V., Gaastra International Sportswear B.V., Gaastra Retail B.V., McGregor E-store B.V., McGregor Fashion Group B.V. and McGregor Retail B.V., with appointment of mr. M.R. van Zanten as administrator.
By decision of the district court of first instance of Amsterdam, the Netherlands, of 28 June 2016, Adam Menswear B.V., CoFi Maastricht B.V., DENO B.V., EMERGO SPORTSWEAR B.V., McGregor Fashion Group Holding B.V., Gaastra International Footwear B.V., Gaastra International Sportswear B.V., Gaastra Retail B.V., McGregor E-store B.V., McGregor Fashion Group B.V. and McGregor Retail B.V. (the "McGregor Group") have been declared bankrupt (in staat van faillissement verklaard), with appointment of mr. M.J.E. Geradts as supervisory judge and appointment of mr. M.R. van Zanten and mr. M.N. de Groot as trustees in bankruptcy.

The activities of the McGregor Group mainly relate to retail and wholesale activities with regard to clothing in the Netherlands, Europe, Asia and the United States of America.
On 15 July 2016 after conclusion of the sales process the trustees of the McGregor Group and the pledgees reached an agreement on the conditions of a restart. The restart by Doniger Fashion Group B.V. includes all McGregor and Gaastra brand activities, retailer ADAM Menswear and the "corporate wear" division ETP.
The members of the board of Doniger Fashion Group B.V. are Joep van Straaten and Kris van Mierop. As a result of this transaction the goin concern of the group is assured . Furthermore, 377 jobs of the Dutch enteties of the McGregor Fashion Group are safeguarded. In addition, Doniger Fashion Group B.V. acquired the shares in several other subsidiaries of the McGregor Group as a result whereof a substantial part of the foreign employment is preserved.
NIBC Bank, Marcel Boekhoorn, Jeroen Schothorst and Ben Kolff have, as shareholders of Doniger Fashion Group B.V., financially supported this transaction.
CEO Joep van Straaten has indicated that the company will announce its future plans and strategy within the next three months. At this stage the company needs to focus on the ongoing business.
It is expected that the first public bankruptcy report will be published early September 2016. This report will further outline the sale process and more details regarding the restart.
