Join us for our upcoming UPC Case Law webinar series, marking the third anniversary of the Unified Patent Court and bringing together leading CMS practitioners from across Europe to discuss key recent UPC decisions and emerging litigation trends.

Session 1 – Jurisdiction & Validity

Long‑arm jurisdiction at the UPC

The recent rulings in FUJIFILM v Kodak and Dyson v Dreame demonstrate how the UPC is exercising its long‑arm jurisdiction in line with the precedent set by BSH v Electrolux. Claimants and defendants alike must prepare for new litigation strategies resulting from these developments. We will assess the implications from both European and UK perspectives.

Obviousness / Inventive step at the UPC

Is it obvious? This session explores how the UPC approaches the assessment of inventive step and what this means for patent protection in Europe. We will unpack the UPC’s emerging practice, including the test articulated in Amgen v Sanofi and Meril v Edwards, and its application at first‑instance level.

Session 2 – Enforcement & Injunctions

Standard Essential Patents (SEPs) before the UPC

An overview of early UPC case law and procedural practice relating to SEPs, with a focus on enforcement strategies and practical lessons for both rights holders and implementers.

Directors’ personal liability & preliminary injunctions

This session highlights the UPC’s approach to the personal liability of company directors, alongside requests for preliminary injunctions. We will discuss the circumstances under which a director may become personally liable, the measures that can be taken to mitigate risks, and the specific implications of directors’ liability in injunction proceedings, including insights from Philips v Belkin.

Across both sessions, the focus will be on practical takeaways for companies and litigators navigating UPC disputes.
