Constantin Kurtz has 20 years of experience representing clients in patent litigation before German courts and the Unified Patent Court (UPC). He conducts patent infringement and validity proceedings, at national level especially infringement proceedings before the relevant civil courts as well as parallel nullity proceedings before the German Federal Patent Court (BPatG) and on appeal before the German Federal Court of Justice. He is also authorised to act as a representative before the UPC and regularly conducts preliminary injunction proceedings, including proceedings for the preservation of evidence.

His industry specialisms include semiconductors, mobile communications and IoT – including SEP/FRAND constellations – as well as automotive, mechanical engineering and fastening technology. He represents both research-based companies in connection with the enforcement of their patents as well as manufacturing companies in claim situations. His clients range from hidden champions to listed corporate groups.

Constantin Kurtz has been working as a lawyer since 2006 and was partner of a law firm specialising in patent and trademark law from 2013. He joined CMS in 2026. He is also a lecturer at the University of Hagen as part of the continuing education programme for patent attorneys to obtain the European Patent Litigation Certificate.

Relevant experience

Infineon v Innoscience, representing Infineon as claimant before Munich Regional Court I against the Chinese competitor Innoscience in the field of the latest generation of gallium nitride semiconductor devices. The German patent DE 10 2014 113 465 was enforced. Munich Regional Court I ordered Innoscience to cease and desist, pay compensation, provide information and render accounts

OROPE Germany GmbH v KPN, successfully defended OPPO's German subsidiary against legal actions brought by KPN before Düsseldorf Regional Court regarding European patents EP 2 377 337 and EP 2 291 033

both in the context of his former activity.
