Aleksander Grabecki is an advocate and a counsel in the Real Estate and Construction Department at CMS.

For more than a decade, he has advised on local and cross-border real estate transactions and major development projects in Poland and Central and Eastern Europe at every stage of the investment process and in all market segments. He specialises in office, retail, logistics and residential projects, in both the private and public sectors, as well as projects based on alternative asset classes, such as data centers and student housing. In addition, he advises on structuring transactions, financing and refinancing of real estate.

He is an expert in the field of commercial lease. He has extensive experience in particular in large projects in the office, retail, warehouse, and hotel markets, on both the landlord and tenant sides, as well as in the innovative area of green/sustainable lease. In addition, he supports clients in other real estate and asset management matters.

He also specialises in preparing and negotiating construction contracts, including FIDIC contracts, project management and development agreements, as well as design work agreements, including those based on BIM (Building Information Modeling).

In addition, he works with various entities on projects involving new technologies and digitisation, including the implementation of ESG and BIM (Building Information Modeling) in the real estate and construction sectors in Poland.

He is a guest lecturer at the Warsaw University of Technology on ESG aspects related to construction.
Aleksander has a track record of pro bono consulting, including for leading cultural institutions in new construction projects. He also successfully represents clients in complex administrative and administrative-court cases as well as civil proceedings.

  • Allianz Real Estate and Curzon Capital Partners III, L.P. (CCP III) managed by Tristan Capital Partners on the sale of the  Warsaw Financial Centre, iconinc office tower, including coordinating the due diligence process and negotiating the sale agreement.
  • AFI Europe on the acquisition of several developed and undeveloped properties and comprehensive advisory regarding development projects.
  • Commerzbank and Credit Suisse on the sale of the Zielony Targówek shopping centre to Catalyst Investment Fund.
  • Motel One on entry into the Polish market, advice on the financing and purchase of real estate and execution of a hotel investment.
  • Vienna House on the purchase and financing of the hotel project in Cracow, Poland.
  • Allianz Real Estate on the legal advice in the area of negotiating lease agreements and issues involving management of commercial real estate. 
  • HB Reavis on the legal advice on leasing of the telecom antenna at the top of Varso Tower and several aspects related with leasing of the office projects. 
  • CMS in negotiating a long-term lease agreement for head office in Poland (7 000 sq.m.).
  • Avon Cosmetics Polska on legal advice in connection with the sale of the company’s real estate.
  • Karimpol on comprehensive advice in leading role in negotiating lease agreements for the Skyliner building located in Warsaw, as well as property and asset management.
  • TJX on preparing a range of template agreements in an investment process on the basis of the terms of the FIDIC rainbow contract (including a set of design and build and build agreements, servicing agreements, etc.), as well as negotiations concerning the comprehensive fit-out of a logistics centre with automatics, installations and building systems, as well as shelves.
  • Lufthansa Technik i GE Aviation on comprehensive legal assistance on the tender process of appointing contractors and negotiating of the FIDIC design & build and turn-key contracts for designing and development of the MRO and Test Cell facilities intended for maintaining and testing of airliners’ engines located in Środa Śląska.
