Anna Wilkosz is an advocate in the Antitrust, Competition and Trade group at CMS Poland, advising clients across the full spectrum of competition and consumer protection matters. She advises in particular on horizontal and vertical cooperation arrangements, consumer law compliance, competition law dimensions of mergers and acquisitions, abuse of dominance, unfair competition and state aid.
She represents clients before both EU and national authorities, including the European Commission and the Polish Office of Competition and Consumer Protection (UOKiK) in consumer protection, antitrust and merger control cases.
She has extensive experience in advising on general commercial contracts and consumer law issues, including the drafting and review of consumer terms and conditions, the verification of marketing and promotional campaigns and the practical implementation of consumer facing information and transparency obligations in particular in the e-commerce sector.
Her expertise also includes structuring transactions and business initiatives to manage antitrust risk, with a particular focus on designing and reviewing distribution frameworks, pricing policies and commercial agreements to ensure compliance with EU and Polish competition law. She also supports clients in internal investigations and during authority’s dawn raids.
