Michał Andruszkiewicz is a Polish-qualified advocate and a partner in the Energy and Infrastructure Practice at CMS Poland, where he heads the CMS Poznan Office. With 18 years of experience, he specialises in advising clients in the energy, chemical and petrochemical sectors on a variety of legal issues.
His expertise includes the development of large-scale industrial projects, new gas-steam and coal-fired power blocks, and investments in renewable energy sources. He has extensive experience in preparing and negotiating EPC contracts, long-term gas supply contracts, power purchase agreements (including cPPA – both physical and virtual), grid connection agreements, FEED contracts, PMC contracts, licence agreements for technologies, and various types of construction and equipment supply contracts, particularly in projects implemented in a multi-contract format. He also deals with FIDIC contracts and operation and maintenance agreements.
Michał has led legal teams on numerous large-scale projects, including: (i) the construction of a copper smelter, (ii) the construction of propylene and polypropylene production facilities, (iii) the contracting structure for an olefins plant; (iv) an upstream gas project; (v) the construction of an LNG terminal; (vi) the construction of a waste-to-energy installation; and (vii) a cross-border electricity interconnection. Michał has also participated in numerous M&A transactions in the Polish renewable energy sector, providing advice to investors developing BESS projects. He also advises on regulatory issues related to the operation of energy and gas markets.
