Marquard Christen specializes in commercial public and administrative law, with a particular focus on competition (antitrust) and public procurement law, as well as regulated markets, compliance and ESG (Environmental Social Governance) matters. He heads the firm's competition and public procurement practice groups, and is a member of the global CMS competition group's steering committee.

Marquard advises Swiss and international companies on all aspects of Swiss and EU competition law (horizontal and vertical agreements, dominance abuse and economic dependence, merger control and civil antitrust law) and represents them in proceedings before competition authorities and courts. Over the past 20 years, he has gained special knowledge in various industries including automotive, construction, consumer goods, energy, IT services, payment solutions, pharmaceuticals and telecommunications. In public procurement, Marquard advises on all aspects of procurement law on both a federal and cantonal level. He supports and represents bidders and procuring entities in the tender process and in appeal proceedings and advises purchasing bodies in the design and management of their tenders. Marquard also advises on other administrative law and regulatory topics, e.g. related to the energy sector or in proceedings under the Federal Act on Freedom of Information in the Administration, as well as on compliance (compliance programs, audits, internal investigations and trainings) and ESG matters (including sustainable supply chains).

Marquard joined our firm as a trainee in 2001 and continued working for CMS as an associate after being admitted to the bar in 2003. From 2009 to 2010 he worked as a delegate of the International Committee of the Red Cross before returning to CMS in 2011. Marquard is also an investigator appointed by the Swiss Bankers Association with regard to the enforcement of the Swiss Code of Conduct on the Due Diligence of Banks (CDB) and a member of the Expert Committee on Digitalisation of the Swiss Bar Association. He regularly lectures and publishes in his fields of expertise.

Apart from commercial law, Marquard is committed to the advancement of human rights and international humanitarian law.

Zurich, March 2024 | An international CMS team under the lead of Stefan Brunnschweiler and Florian Jung provided comprehensive advice to Ypsomed (SIX: YPSN) on all legal aspects regarding the sale of its pen needle and blood glucose monitoring systems (BGMs) businesses to Medical Technology and Devices S.p.A. (MTD). Ypsomed is supporting a reliable transition to ensure the supply of pen needles to people around the globe who inject insulin and other hormones. During a transition period, Ypsomed will produce pen needles as a contract manufacturer and provide certain services to facilitate a seamless transfer. The production equipment will be gradually moved to the MTD sites by mid-2025. The business with pen needles and BGMs to be transferred to MTD accounted for sales of CHF 52 million in FY 2022/23 and CHF 18 million in the first half of FY 2023/24. The closing of the transaction and thus the transfer of the business with pen needles and blood glucose monitoring systems is expected in summer 2024, after which the transition will begin, and is subject to customary respectively regulatory conditions. Ypsomed is the leading developer and manufacturer of injection and infusion systems for self-medication and a renowned diabetes specialist. The company will celebrate its 40th anniversary in 2024. Zurich, December 2023After thorough examination, the owner families of Hunkeler AG and Müller Martini AG have decided to merge the Hunkeler Group with the Müller Martini Group. Müller Martini Holding AG has acquired all shares of the Hunkeler Group in this transaction. SYNLAB and Sonic have announced the sale of SYNLAB Suisse SA to Sonic Healthcare for a purchase price of CHF 150m, having received the required approval of the Swiss antitrust authority. Closing of the transaction expected for 3 July 2023.

The Swiss investor Capvis, which specialises in medium-sized investments, acquires a majority stake in the Lucerne-based SCHURTER Group. The founding and previous owner family continues to hold a stake in the company and is represented on the board of directors by Thomas Schurter.

9. Dezember 2022DER Touristik Suisse AG has sold a minority stake in RAILTOUR (SUISSE) SA to ÖBB subsidiary Rail Tours Touristik GmbH. With this step, DER Touristik Suisse AG aims to expand the rail expertise of its subsidiary RAILTOUR (SUISSE) SA in the growth market for sustainable rail travel. The cooperation with ÖBB is also intended to strengthen RAILTOUR (SUISSE) SA in the development of its sales expertise and access to new customer groups. DER Touristik Suisse AG is a market-leading Swiss tourism company and covers the entire spectrum of the travel world with its tour operators Kuoni, Helvetic Tours and specialist tour operators. Zurich, 28 October 2022The Voigt Group and PHOENIX Pharma Switzerland have agreed to merge their subsidiaries, each active in pharmaceutical logistics and pharmaceutical wholesale sectors respectively, into a 50/50 joint venture. CMS advised ACE SWISS Group on the sale of a majority stake in Casinò Locarno...
Zurich, 22 September 2022The ACE SWISS Group has sold a majority stake of 81% in Casinò Locarno SA to Stadtcasino Baden AG and will retain a 19% stake. Besides Caisnò Locarno, the ACE SWISS Group operates Casino ADMIRAL in Mendrisio. In addition, it also holds minority stakes in other leading Swiss casinos: Casino Bad Ragaz, Casino Interlaken, and Stadtcasino Baden.
