Marquard Christen se spécialise en droit commercial public et administratif, mettant particulièrement l'accent sur le droit de la concurrence (antitrust), le droit des marchés publics, les marchés réglementés, la conformité et les questions liées à l'ESG (Environnement, Social, Gouvernance). Il dirige les groupes de pratique en droit de la concurrence et des marchés publics du cabinet, et est membre du comité directeur du groupe mondial de concurrence de CMS.

Marquard conseille des entreprises suisses et internationales sur tous les aspects du droit de la concurrence suisse et de l'UE (accords horizontaux et verticaux, abus de position dominante et dépendance économique, contrôle des concentrations et droit civil de la concurrence) et les représente dans les procédures devant les autorités de la concurrence et les tribunaux. Au cours des 20 dernières années, il a acquis une expertise particulière dans divers secteurs, notamment l'automobile, la construction, les biens de consommation, l'énergie, les services informatiques, les solutions de paiement, les produits pharmaceutiques et les télécommunications.

En droit des marchés publics, Marquard conseille sur tous les aspects du droit, tant au niveau fédéral que cantonal. Il soutient et représente les soumissionnaires et les entités adjudicatrices dans le processus d'appel d'offres et dans les procédures de recours, et conseille les organes d'achat dans la conception et la gestion de leurs appels d'offres. Marquard conseille également sur d'autres questions de droit administratif et réglementaire, par exemple dans le secteur de l'énergie ou dans le cadre de procédures en vertu de la Loi fédérale sur le principe de la transparence dans l'administration, ainsi que sur la conformité (programmes de conformité, audits, enquêtes internes et formations) et les questions liées à l'ESG (y compris les chaînes d'approvisionnement durables).

Marquard a rejoint notre cabinet en tant que stagiaire en 2001 et a continué à travailler pour CMS en tant que collaborateur après avoir été admis au barreau en 2003. De 2009 à 2010, il a travaillé en tant que délégué du Comité international de la Croix-Rouge avant de revenir chez CMS en 2011. Marquard est également enquêteur désigné par l'Association suisse des banquiers en ce qui concerne l'application de la Convention relative à l'obligation de diligence des banques (CDB) et membre du Comité d'experts sur la numérisation de l'Association suisse des avocats. Il donne régulièrement des conférences et publie dans ses domaines d'expertise.

Outre le droit commercial, Marquard est engagé à la promotion des droits de l'homme et du droit international humanitaire.

Zurich, March 2024 | An international CMS team under the lead of Stefan Brunnschweiler and Florian Jung provided comprehensive advice to Ypsomed (SIX: YPSN) on all legal aspects regarding the sale of its pen needle and blood glucose monitoring systems (BGMs) businesses to Medical Technology and Devices S.p.A. (MTD). Ypsomed is supporting a reliable transition to ensure the supply of pen needles to people around the globe who inject insulin and other hormones. During a transition period, Ypsomed will produce pen needles as a contract manufacturer and provide certain services to facilitate a seamless transfer. The production equipment will be gradually moved to the MTD sites by mid-2025. The business with pen needles and BGMs to be transferred to MTD accounted for sales of CHF 52 million in FY 2022/23 and CHF 18 million in the first half of FY 2023/24. The closing of the transaction and thus the transfer of the business with pen needles and blood glucose monitoring systems is expected in summer 2024, after which the transition will begin, and is subject to customary respectively regulatory conditions. Ypsomed is the leading developer and manufacturer of injection and infusion systems for self-medication and a renowned diabetes specialist. The company will celebrate its 40th anniversary in 2024. Müller Martini Holding AG has acquired all shares of the Hunkeler Group in this transaction. SYNLAB and Sonic have announced the sale of SYNLAB Suisse SA to Sonic Healthcare for a purchase price of CHF 150m, having received the required approval of the Swiss antitrust authority. Closing of the transaction expected for 3 July 2023.

Zurich, 22 September 2022The ACE SWISS Group has sold a majority stake of 81% in Casinò Locarno SA to Stadtcasino Baden AG and will retain a 19% stake. Besides Caisnò Locarno, the ACE SWISS Group operates Casino ADMIRAL in Mendrisio. In addition, it also holds minority stakes in other leading Swiss casinos: Casino Bad Ragaz, Casino Interlaken, and Stadtcasino Baden.
