The question of whether competitors or associations can warn of GDPR infringements on the basis of competition law is now a matter for the courts in numerous countries. In Austria, the Supreme Court recently dealt with this question for the first time and gave very concise reasons why they cannot make such warnings, (OGH 26.11. 2019, 4 Ob 84/19k).
