COVID-19: Certificate necessary to justify presence at the workplace

We would like to draw your attention to the fact that a new ministerial decree was issued this Sunday setting out new measures and obligations for employers, including the following:

1. Teleworking at home is now compulsory in all companies, associations and services for all employees, unless it is impossible due to the nature of the role and the continuity in the company's management, activities or services.

If teleworking at home cannot be implemented, companies, associations and services will have to provide employees who cannot telework at home with a certificate or other proof confirming the necessity of their presence at the workplace

In this respect, we recommend that you appoint, and inform your employees of, a contact person that the employees can contact, in case of control, to justify their presence at the workplace and/or their travel to the workplace. In addition, it would be useful to set up a procedure within the company to deal with any workplace inspection by the social inspection services (e.g. person to call, list of dos and don’ts, etc.).

2. Non-essential businesses and associations supplying goods to consumers are closed to the public. However, deliveries and systems of appointments for collecting goods are still allowed.

Some businesses are exempt from this rule and can remain open, provided that they mainly offer essential goods. The list of these establishments is included in attachment (in French - in Dutch).

These measures apply from Monday 2 November 2020 until and including Sunday 13 December 2020.
