By enacting an amendment to the Act against Restraints of Competition (GWB Digitalisation Act), the German parliament has adapted competition law to meet these challenges. The central element of digital competition law is a modernisation of abuse control across large digital platforms. New rights of access to data under competition law are aimed at safeguarding and fuelling competition in digital markets.
At EU level, the Digital Markets Act (DMA) was passed in July 2022 to ensure fairness in digital markets and open them up to competition. Digital gatekeepers must adhere to strict dos and don'ts for their core platform services, including data use, relationships with third-party providers, how they structure their services and in terms of granting access to services. The EU is thus a frontrunner worldwide in regulating large online platforms.
