German Gambling Regulation According to the Draft Interstate Treaty on Gambling 2021

Gambling regulation in Germany has been in a state of flux for several years but last month the German states finally approved a new regulatory framework which is due to come into force next year. Despite containing a number of provisions which operators were not happy with, at least it will provide some certainty to what has been a very confused market. Earlier this month the Darmstadt Administrative Court has thrown yet another spanner in the works ruling that the licensing process conducted under the current framework was discriminatory and ordering it to be halted. Again, the market is in disarray but we include a summary of the draft new treaty’s provisions prepared by our colleagues at CMS Germany.
