CMS successfully advises in proceedings on price comparison portals

Berlin – In its ruling dated 27 April 2017, the German Federal Court of Justice (BGH) recently confirmed the requirement for price comparison websites to provide additional information. Comparison websites and portals which only include providers that agree to pay a commission if a contract is entered into with the user must disclose this fact in future. The judgment applies to all comparison websites and portals, whether they cover hotels, energy prices or online shopping for goods.

CMS lawyers Prof. Winfried Bullinger and Sabine Mußotter represented the Federal Association of German Undertakers in this specific action against the operators of funeral comparison website Bestattungsvergleich.de. The defendant may no longer provide a comparison website without informing users that it will receive commission from the undertaker in the event that a contract is formed.
