Roman Kies advises German as well as international clients on all aspects of individual and collective employment law, with a primary focus on the strategic planning, support and implementation of transformation initiatives, including restructuring, outsourcing and flexibilization projects, particularly involving collective bargaining. In this context, he also handles all related negotiations with works councils and trade unions. Roman has special expertise in matters pertaining to works council co-determination, especially with regard to remuneration systems and IT, as well as M&A transactions and company pension schemes. He negotiates works agreements, reconciliations of interests and social plans as well as collective bargaining agreements, also advising on the migration of remuneration systems and on pension scheme amendments.

Roman joined CMS in 2019 and was made counsel in 2023. He started his career as a lawyer with a medium-sized law firm in 2015 before moving to an internationally operating UK law firm in 2017. Roman also has long-standing experience in academic teaching, gained during his time as a research assistant at the University of Duesseldorf.

The many strikes in recent weeks have re-focused attention on this subject, raising a number of issues: What requirements must be met in order for a strike to be deemed lawful? What is the status of days of action organised by trade unions, where the objective also includes climate policy goals (e.g. achieving a turnaround in mobility)? What can employers do to prepare for industrial action?
