The past couple of years have seen a sharp increase in NPL transactions, both on the corporate and retail side. The change has been brought about both by a desire on the seller banks' side to clean up their books and favourable regulatory changes. At the same time, the potential entry of new investors has raised new types of regulatory challenges, as well as a realisation that the current licensing regime was not devised for NLP transactions and that such transaction needs to be preceded by thorough exploration of the licensing status of the potential purchaser entity.
