France has long been regarded as a leading jurisdiction for international arbitration, but how often do parties succeed when they seek to set aside arbitral awards in practice?
In the latest article of the CMS Arbitration Atlas series, our arbitration team analyse court decisions issued between 2022 and 2025 to assess the reality of set aside proceedings against international awards rendered in France. Drawing on decisions of the Paris Court of Appeal and the Supreme Court, the article examines how frequently challenges are brought, the limited grounds on which awards are annulled, and the extent to which appellate review is available in practice.
The data shows that annulment remains exceptional, with the Paris Court of Appeal dismissing most applications and the Supreme Court rarely intervening. The article also considers upcoming reforms to French arbitration law and their potential impact on challenges to foreign awards.
