The Law entered into force on 1st August 2023 and aims to modernize company law, by enhancing the use of electronic format, particularly for notarial deeds.
All notarial deeds (except for wills) can now be made in electronic format, signed with electronic signatures, and drawn up remotely, without the parties being present or represented at the notary’s office.
It is now also possible for public and private limited liability companies and for partnerships limited by shares to be incorporated online.
Notarial deeds in electronic format are valid as originals and have the same evidential value as notarial deeds in paper format, provided the conditions set out in the Civil Code are met.
