The Luxembourg Right of Establishment reform entered into force on 1st September 2023, with a two-year transition period for existing business license holders. The reform aims to boost entrepreneurship with key changes, such as facilitating the granting of new business licenses after bankruptcy due to specific reasons. The requirement for license holders to be partners, shareholders or employees is removed: they now only need to be registered with the RCS as a representative of the company. New conditions include the company’s tax compliance and debt limitations, while certain craft professions no longer require qualifications. Administrative procedures are simplified through regular data exchange, and business licenses are now issued online.
