Acuerdo Voluntario entre Sector Gasolinero y Gobierno Federal

El 27 de febrero de 2025, la presidenta Claudia Sheinbaum, con la participación de diversas autoridades[1], firmó un acuerdo con directores y representantes de diversas empresas gasolineras para fijar un precio de la gasolina con octanaje menor a 91, que no exceda de MXN$24 por litro, contemplando un “diferencial razonable” máximo de MXN$2 sin incluir el impuesto al valor agregado, respecto de los precios de mayoreo a los que vendan Pemex y otros importadores comercializadores relacionados.

El acuerdo es voluntario y tiene una vigencia de seis meses para posteriormente ser evaluado y en su caso se modificado, dependiendo de su efectividad, y no impone obligaciones adicionales forzosas.  no aplicará a las estaciones de servicio ubicadas en zonas transfronterizas.

Para el sector público, PEMEX instrumentará en las terminales de almacenamiento y reparto un precio mayorista nacional. Asimismo, PEMEX y las empresas firmantes se comprometieron a revisar sus políticas de comercialización de combustibles con el fin de mejorar las condiciones de mercado con el fin de mejorar el precio promedio nacional.

Dichos acuerdo voluntario continúa bajo implementación de mesas de trabajo conjuntas entre las empresas privadas y el gobierno federal. Su implementación deberá ser monitoreada y analizada con el fin de asegurar su cumplimiento y evitar riesgos legales para las empresas firmantes.

Voluntary Agreement between the Gas Station Sector and the Federal Government

On February 27, 2025, President Claudia Sheinbaum signed an agreement with various gas station companies to set a price for gasoline with an octane rating of less than 91, capped at MXN$24 per liter, considering a maximum 'reasonable differential' of MXN$2, excluding value-added tax, relative to wholesale prices at which Petróleos Mexicanos (PEMEX) and other related importing marketers sell.

The agreement is voluntary, valid for six months, and subject to evaluation and potential amendment based on its effectiveness, without imposing additional mandatory obligations. It will not apply to service stations in cross-border areas.

Regarding the public sector, PEMEX will implement a national wholesale price in storage and distribution terminals. Likewise, PEMEX and the signatory companies committed to reviewing their fuel marketing policies to enhance market conditions and the national average price. 

The implementation of this voluntary agreement is ongoing through joint working groups between private companies and the federal government. Its implementation must be monitored and analyzed to ensure compliance and avoid legal risks for the signatory companies.
