Simon Polkerman is partner and member of the Dispute Resolution practice area group of our firm in Amsterdam.
He specialises in commercial litigation and contracting. Acting on behalf national and international companies, he has broad experience in all types of litigation (at all levels of the judiciary in the Netherlands), arbitration and alternative dispute resolution in large commercial matters.
He has worked on numerous important matters and in various areas of expertise, such as mass claims and class actions, general liability law, proceedings regarding contractual underperformance, alleged cross-border unlawful acts, contracting, post-M&A and joint venture disputes (for example, his recent work includes a $500 million commercial dispute between shareholders involved in the exploration of an off shore oil field, with litigation and arbitration in various jurisdictions at the same time).
His work includes all relevant aspects related to complex dispute resolution, such as advice on strategy, interim measures, stakeholder management and complex settlement negotiations, multi-disciplinary and multi-jurisdictional proceedings, arbitration and alternative dispute resolution. He also advices on various contracting matters which are closely related to the litigation practice and his practice consists of a wide variety of matters (interim proceedings, proceedings on the merits, first instance and appeal proceedings, various specific proceedings e.g. discovery/843a DCCP, attachment, enforcement, witness hearings, etc.).
Before joining CMS, Simon spent 12 years working as a lawyer at the international litigation and arbitration practice of De Brauw Blackstone Westbroek (ranked Tier 1).
