CMS has advised Orlen S.A. on the licensing documentation for the development of Small Modular Reactors (SMRs) in Poland. The project is being carried out by Orlen Synthos Green Energy (OSGE), a joint venture between Orlen and Synthos Green Energy.

The scope of CMS’s work included support with renegotiation of the licensing documentation for the BWRX-300® technology, and legal advice in Poland and selected international jurisdictions.

The project was led by Marcin Bejm, supported by Paweł Ura and Karolina Tatomir (Energy & Infrastructure) and Aleksandra-Kuźnicka Cholewa, Ph.D. (Intellectual Property & Technology, Media & Telecommunications). Tax structuring was handled by Piotr Nowicki and Maciej Brezdeń (Tax).

CMS has Poland’s leading Energy & Infrastructure practice and has advised on some of the largest and most complex investment projects in the renewables, nuclear and energy storage sectors for many years. The team supports clients at every stage of project development, including M&A transactions and investment structuring, comprehensive regulatory advice, and contracting and operational issues.

The firm has continuously maintained its leading position in the Chambers & Partners, Legal 500 and IFLR1000 international rankings. In the CEE region, CMS is Band 1 ranked by Chambers & Partners for Projects and Energy, the highest level of recommendation.
