Mbali an Associate in the Banking and Finance team at CMS South Africa.

Her experience on cross border bilateral and syndicated matters spans, general corporate finance, leveraged finance, asset finance, acquisition finance and project financing transactions, where she has acted as both lead and local counsel.

She has a keen interest in development financing and acted for a number of local and international banks, niche lending institutions, DFIs, funds and public entities ranging across Africa and Europe in both transactional and advisory roles. She also holds a Masters in International Commercial and Economic Law, with a focus on policy trends in the regulatory treatment of foreign direct investment within traditionally typed developing markets.
 

Relevant experience

  • African Development Bank Group - on a significant 25-year, $1 billion (ZAR 18 billion) loan to Transnet SOC Limited. This loan is backed by a guarantee from the Government of South Africa and is a key part of Transnet’s recovery plan.
  • Large Commercial Bank - (acting through its UK division) to provide a facility of EUR15 000 000 to a Swiss and Spanish obligors towards an Angolan road project.
  • A Development Finance Institution - advising in relation to a ZAR 114,480,000 financing to be provided to a renewable energy group as part of a rooftop solar project.
  • Exxaro Resources Limited – in relation to the company’s divestment in Exxaro FerroAlloys funded by way of equity funding, third party debt funding and vendor funding, tailored to suite Exxaro’s exposure appetite.
