Nikolaus Weselik, together with Adrian Bell from CMS Cameron McKenna, are speaking about Time Bar Application under Civil Law and Common Law Perspective. The time bars for both Contractor and Employer claims are essential elements of the FIDIC Conditions of Contract. Their project management purpose is however not always fully understood by the Parties, and their effect on the Contractor in particular is regularly felt as being excessively harsh. This session will provide practical insights as to the reasons behind the application of time bars, their operation under common and civil laws (including recent legal developments), and ways around them.
