CMS advises on continuation of fashion retailer Appelrath Cüpper as going concern

Munich – Fashion retailer Appelrath Cüpper exited insolvency proceedings under self-administration at the end of 2020 and has found a new owner in Austrian fashion entrepreneur Peter Graf. Appelrath Cüpper GmbH filed for insolvency under self-administration in April last year. Appelrath Cüpper GmbH was acquired by a company held by Peter Graf as part of the insolvency plan. The business will be continued as a going concern.

A CMS team headed by lead partner Dr Michael Wangemann advised new owner Peter Graf on all legal aspects of acquiring Appelrath Cüpper in the context of the insolvency plan.

Fashion retailer Appelrath Cüpper was established in 1882 and sells high-quality women’s fashion in 16 stores throughout Germany and online.

Following the termination of insolvency proceedings, Austrian fashion entrepreneur Peter Graf has indirectly become the new sole shareholder of the company. Graf is (co-)owner of Kleider Bauer und Hämmerle, which describes itself as one of the largest fashion retailers in Austria, with around 900 employees and 35 branches.
