CMS represents Infineon Technologies Austria in successful patent infringement proceedings before the Munich I Regional Court
Munich – Infineon Technologies Austria AG has successfully enforced its German patent DE 10 2017 103 054 against several companies of the group Innoscience and the European distributor MEV Elektronik Service in patent infringement proceedings before Munich I Regional Court.
In its judgments of 3 July 2026, the 21st Civil Chamber of Munich I Regional Court held that certain gallium nitride (GaN) semiconductor products offered by the defendants infringe Infineon's patent protecting a specific semiconductor die. The Court ordered the defendants to cease offering and distributing the infringing products in Germany and to provide information and render accounts as well as declaring them liable for damages. The Court also rejected Innoscience's request to stay the proceedings pending the outcome of parallel revocation proceedings before the German Federal Patent Court. The judgments are enforceable against security. Innoscience is expected to appeal.
A CMS team led by partner Dr Constantin Kurtz advised Infineon Technologies Austria AG in the infringement proceedings before Munich I Regional Court. The team represented the client in all legal aspects of the dispute concerning GaN semiconductor components.
The technical aspects of the infringement proceedings were handled by patent attorney Dr Dirk Szynka of Szynka Smorodin, who is also leading the defence of the patent in the parallel revocation proceedings before the German Federal Patent Court, working alongside Dr Constantin Kurtz as cooperating counsel. Dr Constantin Kurtz has been representing Infineon in its patent disputes with Innoscience based on the German patents DE 10 2017 103 054 and DE 10 2014 113 465 since 2024 and continues to represent the company in the ongoing appeal proceedings concerning patent infringement actions regarding DE 10 2014 113 465 before Munich Higher Regional Court.
